The patient and her husband started to lie about Dr. Lesesne and his practice, making false reports to the New York’s Office of Professional Misconduct. The court dismissed the doctor’s lawsuit alleging “tortious interference with contract, business relations, prospective business relations, and economic advantage.” The majority of the doctor’s claims was in defamation and was inadequately pleaded. The court dismissed the doctor’s case because it found the doctor’s position to be in contrary to the “weight of authority requiring that a plaintiff identify potential customers at issue where asserting a cause of action for interference with prospective economic advantage.”
