A New York husband sought to have a religious courtâ€™s arbitration ruling overturned, as reported by the New York Law Journal on August 17th, 2012.
The New York court ruled that the court would have jurisdiction to hear and determine issues regarding child custody and child visitation. However the court found that the arbitration, although established through a religious court, was valid. The divorcing couple had signed an agreement prior to entering into the arbitration.
Due to the signed agreement the court found that it would go against public policy to void the arbitratorâ€™s findings. The court concluded that the ex-husbandâ€™s downward modification was denied but he may bring an action regarding the custody and visitation.
