You’ve been injured, received medical attention, and have now hired a personal injury attorney to help you pursue a claim against the party whose negligence caused your injuries. You want to seek compensation for past and future medical bills, lost wages, medical treatments, pain and suffering and other past and future economic and non-economic losses. But how much money will you actually recover?

When you first meet with your attorney, you’ll likely notice that they will avoid naming a precise figure for the outcome of your case. There are very good reasons for this. One is that no matter much experience your attorney has with personal injury clients, it’s hard to tell right away what your case is worth. There are a lot of factors involved, such as:

  • Future medical costs
  • How long you will require treatment
  • The quality of your recovery

Don’t allow advertisements or news features about huge jury awards or massive settlements raise your expectations about the final outcome of your claim. It is unrealistic, for example, to expect a $1,000,000 award for a soft tissue injury or broken limb. It is extremely rare for a personal injury claimant to receive more than $250,000, and the majority get much less.

Some types of injuries are limited in what you can expect: for example, Worker’s Compensation claims have a cap on how much you can be awarded when no third party is involved in the accident. If the attorney for the other side can prove comparative negligence (in other words, you were at least partially responsible for your injuries), then  any damages will be reduced accordingly.

Eventually, your attorney will assign an actual dollar value to your case. When it comes time to settle, he or she will demand an amount that is higher than their own valuation of the case, so don’t immediately believe that this is how much you will end up receiving. Your attorney is merely getting ready to negotiate, and a good personal injury attorney will do so with the aim of getting a fair settlement for everything you have been through and may go through in the future.

It’s normal to want fair compensation for what you’ve suffered. But by avoiding unreasonable expectations, you and your attorney are in the best position to bring your case to an acceptable resolution.

If you have been injured as the result of someone else’s negligence or misconduct, then you should hire an experienced personal injury attorney right away, before evidence is lost or witnesses begin to forget details.
