A New York panel reviewed and agreed to hear a mother’s petition after the Family Court denied her custody petition, as reported by the New York Law Journal in a December 24th, 2012 article.

The Family Court refused to hear the mother’s request to modify a prior custody order. The original custody order granted primary custody to the father. In addition, based on the father’s allegations the court concluded that the couple’s child should receive services from St. Lawrence County Department of Social Services. These services were for mental health issues that the father claimed the child had.

The child’s mother appealed this order attempting to modify the court’s order. The mother argued that the father physical and verbally abused his children in addition to other dangerous factors. The panel ruled that based on these circumstances the mother was entitled to have order reviewed. The panel concluded that the order would be reversed and remitted to the family court for further action.
