After reviewing all of the petitions regarding these issues, including those made by the mother for sexual abuse, the court found that many were without evidence. The court brought in experts to review all of the parties involved to determine what would be in the best interest of the child.

The court concluded that the mother was making false allegations of sexual abuse against the father in an effort to prohibit the father from being in the child’s life. The court’s expert found that the father had never sexually abused the child in any way but did find that the mother had neglected the child numerous times. Based on the facts and the court’s findings the court ruled that the father should have sole custody of the child. Specifically the court found that the child would be mentally and emotionally harmed it was were to stay in the custody and care of the mother.
