Malikiat G. claimed that his name and date of birth were incorrectly reported on the birth certificate due to â€œa language barrier and communications error.â€ Although there was no presented opposition to the requested changes, the court held that the changes were barred because Malikiat’s application was deficient. Malikiat never submitted a request to the New York Department of Health, Vital Records Division; therefore, the application to the court was premature. Furthermore, the court required objective proof of paternity before it could consider the submitted application.
