Bronx LawyerA father’s request to amend both his name and date of birth on his child’s birth certificate has been denied, as reported by the New York Law Journal on October 17, 2012.

Malikiat G. claimed that his name and date of birth were incorrectly reported on the birth certificate due to “a language barrier and communications error.” Although there was no presented opposition to the requested changes, the court held that the changes were barred because Malikiat’s application was deficient. Malikiat never submitted a request to the New York Department of Health, Vital Records Division; therefore, the application to the court was premature. Furthermore, the court required objective proof of paternity before it could consider the submitted application.
