A New York Family Court granted the Washington County Department of Social Service (DSS) motion for summary judgment thus terminating the parental rights of an 18 month old. The New York Law Journal reported in a July 10th, 2012 news article that the parents had abandoned the child for more than six months creating legal standing to have their rights terminated.
Additionally, the Court found that prior to the DSSâ€™ petition an order of protection had been issued by the Family Court for parental neglect. The Court found that the parentsâ€™ failure to uphold the guidelines set by the order of protection showed they were not fit as parents. The Court granted the DSS motion finding the child would be placed in danger if they were placed in the parentsâ€™ care.
