A New York mother lost her petition to the child’s father who denied paternity, as reported by the New York Law Journal in a September 14, 2012 article.
Upon learning that he was the biological father both the mother and father petitioned seeking sole custody of the child. After reviewing the submitted evidence and documents the court found that under the legal standard of â€œbest interest of the childâ€ the court ruled in favor of the father.
Although the father originally denied being the biological father, the court found that he was both financially and mentally more stable than the child’s mother. The court noted in their findings that the mother had been found to be physically and emotionally neglectful towards the child. On numerous occasions the court found that the mother chosen her own â€œrelationshipsâ€ over the child.
Due to the instability of the mother, the court ruled that in the best interest of the child that the child would be in the care and control of the father. The mother was granted some parenting rights including reasonable visitation.
